1. About these terms

These Terms of Service (“Terms”) form an agreement between you and Hallmark Financial Bank (“Hallmark”, “we”, “us”) and govern your use of our website, app and services. By creating an account or using the services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the services.

2. Eligibility

You must be at least 18 years old, have legal capacity to enter into this agreement, and live in a country where we offer our services. You may hold only one personal account and must not open an account on behalf of anyone else.

3. Your account and identity verification

You must give accurate, complete and current information and keep it up to date. We are required to verify your identity before you can use some or all features, and we may ask for further information at any time. We may refuse, limit or close an account if we cannot verify your identity or if verification raises concerns.

4. Keeping your account secure

You are responsible for keeping access to your sign-in email account and devices secure. Do not share one-time codes with anyone; Hallmark will never ask for them. Tell us immediately if you suspect unauthorised access. You may be responsible for losses caused by your failure to keep your account secure, to the extent permitted by law.

5. Wallets, transfers and payments

  • You can hold balances in the currencies we support, move money between your own wallets and send money to saved payees.
  • You must check payee details carefully before confirming a payment. Payments cannot always be recalled once sent.
  • We may delay, block or reverse a transaction where we suspect fraud, error, a breach of these Terms, or where the law requires it.
  • Exchange rates shown in the app are indicative and may change between quoting and completing a transaction.

6. Cards

Cards remain our property and are linked to your wallet. You must keep card details confidential and may freeze a card at any time in the app. Report a lost or stolen card or unrecognised activity straight away.

7. Loans

Loan limits and repayment figures shown in the app are estimates only and do not constitute an offer. All applications are subject to assessment and approval. If a loan is approved, it will be governed by a separate loan agreement setting out its terms, rate and repayment schedule.

8. Fees

Any fees that apply to a service will be shown to you before you confirm it. We will give you advance notice of any changes to our fees.

9. Prohibited use

You must not use the services:

  • for any unlawful purpose, including money laundering, terrorist financing, fraud or evading sanctions;
  • to receive or send money on behalf of a third party without our consent;
  • to interfere with, probe or attempt to gain unauthorised access to our systems or other customers’ accounts;
  • in a way that infringes the rights of others or breaches these Terms.

10. Suspension and closing your account

You may close your account at any time by contacting support, once any outstanding balances, cards and obligations are settled. We may suspend or close your account, with notice where we are allowed to give it, if you breach these Terms, if we are required to by law, or to protect you, us or others from harm. Remaining funds will be returned to you, subject to any legal restrictions.

11. Availability of the service

We aim to keep the services available at all times but do not guarantee uninterrupted access. We may carry out maintenance, change features, or temporarily suspend access to keep the services secure.

12. Liability

Nothing in these Terms limits liability that cannot be limited by law. Otherwise, we are not liable for indirect or consequential losses, for losses caused by events outside our reasonable control, or for losses arising from your breach of these Terms. Where we are liable, our liability is limited to the amount of the transaction concerned, to the extent permitted by law.

13. Changes to these terms

We may update these Terms from time to time. We will give you reasonable notice of material changes in the app or by email. If you continue to use the services after the changes take effect, you accept the updated Terms; if you do not agree, you may close your account.

14. Governing law and complaints

These Terms are governed by the laws of the country in which Hallmark is registered, without affecting any mandatory consumer protections in your country of residence. If you have a complaint, contact support through the app and we will try to resolve it promptly. If you are not satisfied with our response you may be able to refer it to a financial ombudsman or regulator.

15. Contact us

Questions about these Terms can be sent to our support team through the app.
